These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and StayVizible, owned and operated by Enechi Njeze, based in Herndon, Virginia ("StayVizible," "we," "us," or "our").
By completing a payment, checking the agreement boxes on our payment page, or engaging StayVizible for any service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not proceed with payment.
You represent that you are at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or the business entity you represent.
StayVizible provides web design, development, and related digital services across the following tiers:
The specific scope of work, including number of pages, features, integrations, and deliverables, is defined by the tier selected and any written agreement exchanged via email or WhatsApp prior to project commencement. Add-on modules and custom features are scoped and priced separately.
StayVizible reserves the right to decline any project that conflicts with our values, capacity, or these Terms.
All projects require a 50% non-refundable deposit to begin. The remaining 50% balance is due in full on or before the day the completed site is handed over to the client.
Payments are processed through Square. By submitting payment, you authorize StayVizible to charge the stated amount to the card provided.
Work does not begin until the deposit is received and confirmed. StayVizible is not responsible for delays caused by late payment.
All prices are stated in US dollars. StayVizible does not offer payment plans or installment arrangements unless agreed in writing before the deposit is paid.
The 50% deposit is non-refundable once work has commenced. Commencement is defined as the first discovery call, written communication of project kick-off, or any design or development work performed by StayVizible, whichever occurs first.
If you cancel your project in writing before a discovery call has been scheduled and before any work has begun, you may be eligible for a partial refund of the deposit at StayVizible's sole discretion, minus a 10% administrative fee.
Once work has commenced, the deposit is fully non-refundable under all circumstances, including but not limited to: change of mind, business closure, failure to provide required materials, or dissatisfaction with the direction of the project.
If the project is cancelled by StayVizible before delivery due to our inability to complete the work, any balance payments made (beyond the deposit) will be refunded in full within 14 business days.
StayVizible will work with you through the revision rounds included in your tier to ensure you are satisfied with the result. Refunds are not offered on the basis of aesthetic preference once the agreed scope has been delivered.
By agreeing to these Terms, you explicitly agree that any payment dispute or chargeback initiated against StayVizible must be preceded by a good-faith written notice to support@stayvizible.dev at least 14 days before filing with any payment processor or bank. Failure to do so constitutes a material breach of this agreement.
StayVizible maintains complete records of all transactions including: IP addresses, timestamps, browser fingerprints, signed digital agreements (the four checkboxes completed at payment), email correspondence, WhatsApp communications, and all deliverables produced.
In the event of a chargeback or unauthorized dispute, StayVizible will submit all available evidence to the payment processor, including the signed agreement, proof of delivery, and all communications. We will vigorously contest any fraudulent or bad-faith disputes.
You acknowledge that initiating a chargeback for services that were rendered as agreed constitutes fraud and may be reported to the appropriate authorities. You agree to be liable for all legal fees and collection costs incurred by StayVizible as a result of a wrongful chargeback.
Delivery timelines begin from the date the deposit is received AND the client has provided all required materials including: brand assets, logo files, color preferences, content, photos, and any other information requested during the discovery call.
StayVizible is not responsible for delays caused by the client's failure to provide materials, respond to communications, or make decisions in a timely manner. In such cases, the timeline resets from when the required materials are received.
Delivery timelines are business days (Monday through Friday, excluding US federal holidays).
Each tier includes a defined number of revision rounds:
A revision round means one consolidated set of changes submitted in a single communication. Multiple separate revision requests may count as multiple rounds. Revisions that expand the original scope of work will be quoted and charged separately.
Upon receipt of full payment (deposit plus final balance), the client receives full ownership of the delivered website files, design, and content created by StayVizible for that project.
StayVizible retains the right to display the completed project in our portfolio and marketing materials unless the client requests otherwise in writing.
Third-party assets including fonts, stock images, plugins, or software libraries remain subject to their respective licenses. The client is responsible for any ongoing licensing costs for third-party assets used in their project.
StayVizible retains ownership of all work product until full payment has been received.
The client agrees to:
StayVizible's total liability to the client for any claim arising from these Terms or any project shall not exceed the total amount paid by the client for that specific project.
StayVizible is not liable for: lost profits, lost business opportunities, indirect damages, consequential damages, or any damages arising from third-party services including hosting providers, payment processors, email providers, or analytics platforms.
StayVizible does not guarantee any specific business results, search engine rankings, traffic volumes, or conversion rates from any website we build.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.
Any dispute arising from these Terms or any project shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the parties agree to submit to binding arbitration in Fairfax County, Virginia, under the rules of the American Arbitration Association.
The prevailing party in any dispute shall be entitled to recover reasonable legal fees and costs.
